Terms of Service
Last updated: January 1, 2024
Welcome to Elliott Tree Service! These terms govern your use of our website and services. By accessing our site or requesting our tree services, you agree to these terms. We're your friendly neighborhood tree experts, and we want everything to be clear and fair for everyone involved.
Service Agreements
When you request tree services from Elliott Tree Service, we'll provide a written estimate detailing the work scope, timeline, and cost. Your acceptance of the estimate creates a binding agreement. We reserve the right to adjust the estimate if we encounter unexpected conditions like hidden decay, underground obstacles, or weather delays that affect the work.
Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept various payment methods including cash, check, and major credit cards. For larger projects, we may require a deposit. Late payments may incur interest charges. All prices are in US dollars and exclude applicable taxes unless specified.
Cancellation Policy
You may cancel scheduled services with at least 24 hours' notice without penalty. Cancellations with less notice may incur a fee to cover our team's preparation time. We may cancel services due to unsafe conditions, weather concerns, or other circumstances beyond our control. We'll reschedule at your convenience when possible.
Property Access and Preparation
You agree to provide safe access to the work area and notify us of any underground utilities, sprinkler systems, or other hidden features. Please clear the area of vehicles, furniture, and personal items before our arrival. We're not responsible for damage to unmarked utilities or items left in the work zone.
Warranty and Guarantee
We guarantee our workmanship for one year from completion date. This covers issues arising from our work, not normal tree growth or unrelated problems. Our satisfaction guarantee means we'll address any legitimate concerns about completed work at no additional cost. Natural materials like wood may have variations beyond our control.
Liability Limitations
While we take every precaution, tree work involves inherent risks. Our liability is limited to the service cost for any claim, except where prohibited by law. We're not liable for incidental, consequential, or punitive damages. We carry proper insurance, but you should maintain your own property insurance as primary coverage.
Website Use
Our website content is for informational purposes only. While we strive for accuracy, we don't guarantee completeness or currentness. You may use our site for personal, non-commercial purposes. Don't misuse the site, attempt unauthorized access, or interfere with its operation. All content is owned by Elliott Tree Service or its licensors.
Third-Party Links
Our website may contain links to third-party sites for your convenience. We don't control these sites and aren't responsible for their content, privacy practices, or accuracy. Links don't imply endorsement. You access third-party sites at your own risk. We recommend reviewing their terms and policies before engaging with them.
Dispute Resolution
If disputes arise, we prefer to resolve them informally through friendly discussion. If formal resolution is needed, you agree to mediation before litigation. These terms are governed by the laws of our operating state. Any legal action must be filed in the appropriate courts in our county. We'll make good faith efforts to resolve issues fairly.
Force Majeure
We're not liable for delays or failures caused by circumstances beyond reasonable control, including severe weather, natural disasters, pandemics, utility failures, strikes, or government actions. In such events, we may suspend or modify services as needed. We'll communicate promptly about any significant delays to your scheduled tree services.
General Provisions
These terms constitute the entire agreement between us regarding our services. If any provision is found unenforceable, the remainder remains effective. Our failure to enforce any term doesn't waive our right to enforce it later. You may not transfer your rights under these terms without our written consent. We may transfer our rights as our business evolves.
